2. Terms of Use
Effective date: [EFFECTIVE DATE]
These Terms of Use ("Terms") are a legal agreement between you and Robles Consulting LLC d/b/a GradeVu, 100 Plaza Pl, Ste 300, PMB 58, Northlake, TX 76226, USA ("GradeVu," "we," "us," "our"), governing your use of the GradeVu app and the website at rarvo.com (the "Service").
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and located in the United States. By using the Service you represent that both are true. We may ask you to verify, and we may suspend or terminate accounts that do not meet these requirements.
2. Your account
Sign in with Apple is the supported sign-in method. You are responsible for the security of your Apple ID and your device.
Provide accurate information and keep it current.
One account per person. Do not create accounts to evade a suspension, abuse free credits, or manipulate public content.
You are responsible for all activity under your account. Tell support@gradevu.com immediately if you suspect unauthorized access.
3. Licence to use the Service
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the app on Apple-branded devices you own or control, as permitted by the Apple Media Services Terms and App Store rules. We reserve all rights not expressly granted.
4. Your content and the licences you give us
"Your Content" means the card photographs you capture or import, the corrections, labels, annotations, and notes you submit, and any profile or community content you post.
You keep ownership of Your Content. You grant us the licences below.
(a) Service licence — required. You grant GradeVu a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, transmit, display, and create derived technical outputs from Your Content solely to operate the Service for you — generating estimates and sub-scores, showing your history, publishing certificate pages you choose to publish, providing support, and securing and debugging the Service. This licence ends when you delete Your Content or your account, subject to backup cycles and the survival terms below.
(b) Research licence — optional, OFF by default. If you turn on Research use, you additionally grant GradeVu and its affiliate rarvo.com a licence to use Your Content for internal research, benchmarking, and model evaluation. This licence does not permit commercial model training, licensing of models to third parties, or public release of your images.
(c) Commercial model licence — optional, OFF by default. If you turn on Commercial model use, you additionally grant GradeVu a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to use Your Content to train, fine-tune, validate, evaluate, and improve machine-learning models, including models used in the Service and models we license, distribute, or otherwise commercialize, and to permit our contractors and service providers to do the same on our behalf.
(d) Withdrawal. You may turn off (b) or (c) at any time in Settings → Privacy & Data. Withdrawal is prospective: it stops new use and we remove your data from datasets assembled after withdrawal within 90 days. Withdrawal does not require us to retrain, recall, or delete models already trained, and it does not require us to remove your data from a model that has already been trained. Trained models do not store retrievable copies of your photos. This is a material term of these Terms.
(e) Public display licence. If you publish a certificate page or post community content, you grant us a licence to display it publicly and to permit other users and search engines to view it, as described in the Public Certificate Page Notice.
(f) Your promises about Your Content. You represent and warrant that:
you personally captured each card image, or you otherwise have the right to submit it;
you own a genuine physical copy of each card you scan, or you are authorized by the owner;
Your Content does not infringe anyone's copyright, trademark, privacy, or other rights, and does not violate law;
Your Content does not contain images of other identifiable people without their permission;
Your Content is not manipulated to misrepresent a card's condition — no compositing, no AI-generated card images, no substituted or borrowed scans, no retouching intended to hide or fabricate defects;
Your Content is not counterfeit, and you are not using the Service to authenticate, value, or market counterfeit items.
You are solely responsible for Your Content. We are not obligated to monitor it but may remove it as described in the Community Guidelines.
5. Feedback
If you send us ideas, suggestions, or corrections about the Service itself (as distinct from Your Content), you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use them without restriction or compensation. Do not send us confidential information you expect to be paid for.
6. AI estimates — read this carefully
GradeVu produces automated estimates. They are not grades.
Our output is a computer-generated estimate of a card's likely condition, produced by machine-learning models that can be wrong. It is an opinion, not a fact, and not a certification, appraisal, or guarantee of condition, authenticity, or value.
We do not authenticate cards. A GradeVu estimate says nothing about whether a card is genuine, altered, trimmed, restored, or reprinted.
Our estimate is not a substitute for a professional grading service and does not predict what any grading company will decide. The same card may receive a different result from any grader, and our models may change over time without notice.
Do not rely on GradeVu for financial decisions. Card values fluctuate. We are not responsible for any purchase, sale, trade, or consignment decision you make.
Models, scoring scales, and sub-score definitions may be updated, which can change estimates for the same images.
Estimates are provided for personal, non-commercial use. Unless we agree in writing, you may not represent a GradeVu estimate as a grade, resell it as a valuation, or use it in a commercial listing in a way that implies certification.
7. No affiliation
GradeVu is an independent company. We are not affiliated with, endorsed by, sponsored by, or approved by The Pokémon Company, Nintendo, Creatures Inc., GAME FREAK inc., PSA (Collectors Universe, Inc.), Beckett Media (BGS), Certified Guaranty Company (CGC), TAG (Technical Authentication & Grading), or any other grading company, marketplace, or brand. All names, logos, and trademarks are the property of their owners and are used only for identification and reference. No GradeVu output is a PSA, BGS, CGC, TAG, or other third-party grade, and none of those companies has reviewed or approved our models. Our use of card images submitted by users is for identifying and evaluating the user's own item and does not claim any interest in third-party artwork.
8. Subscriptions and purchases
Purchases are made through Apple and are subject to Apple's terms. We do not process your payment card.
Auto-renewable subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel in your Apple ID settings.
Refunds are handled by Apple under Apple's policies. We cannot issue App Store refunds.
Prices, plans, and included features may change with notice as required by law and Apple's rules. Free credits, trials, and promotional allowances may be modified or withdrawn.
Deleting the app does not cancel a subscription.
9. Acceptable use
You will not:
use the Service for any unlawful purpose, or in violation of the Community Guidelines;
submit images of other people, images of cards you do not own, or images you scraped or downloaded from elsewhere;
use bots, scrapers, automated capture, or bulk-upload tools, or attempt to reverse-engineer, decompile, or extract our models, weights, thresholds, or datasets;
probe, scan, or test the Service's security, or bypass rate limits, paywalls, or credit systems;
interfere with the Service or other users, or upload malware;
impersonate any person or grading company, or misrepresent an estimate as a third-party certification;
use the Service to grade, verify, or market counterfeit, altered, or stolen cards;
use outputs to train a competing model, build a competing dataset, or benchmark a competitor without our written consent;
resell, sublicense, or commercially redistribute access to the Service or its outputs.
10. Community content, reporting, and blocking
Public certificate pages and any community features are governed by our Community Guidelines, which require you to report objectionable content and let you block other users. We may remove content, restrict features, or suspend accounts to enforce them. See Section 13.
11. Beta and TestFlight
If you use a pre-release, beta, TestFlight, or preview version:
it is provided as-is, may be unstable, may lose data, and may change or be discontinued without notice;
it may include features that never ship, and Apple's Beta Terms apply;
do not rely on a beta for anything important, and do not submit your only copy of any image;
we may revoke beta access at any time;
Sections 6, 12, 13, 14, 15, and 16 apply fully to betas.
12. Our intellectual property
The Service — including our models, software, scoring scales, user interface, text, graphics, and the GradeVu name and logo — is owned by us or our licensors and protected by intellectual property law. These Terms grant you no rights in it beyond Section 3. You may not use our name or logo without written permission.
13. Suspension and termination
We may suspend, restrict, or terminate your access immediately, with or without notice, if you breach these Terms or the Community Guidelines, if we are required to by law, or if your use creates risk or legal exposure for us or others. You may stop using the Service at any time and delete your account in-app.
On termination: your licence to use the Service ends; the required licence in Section 4(a) ends subject to backups and legal retention; the optional licences end prospectively per Section 4(d); and Sections 5, 6, 12, 14, 15, 16, 17, and 18 survive.
14. Disclaimers
THE SERVICE AND ALL ESTIMATES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure, that estimates will be accurate, or that data will never be lost. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST CARD VALUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF WE WERE ADVISED OF THE POSSIBILITY.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50).
These limits do not apply to our fraud, willful misconduct, or anything else that cannot be limited by law.
16. Indemnity
You will defend, indemnify, and hold harmless Robles Consulting LLC and its members, officers, employees, and agents from any claim, damage, liability, and expense (including reasonable attorneys' fees) arising out of Your Content, your breach of these Terms or the Community Guidelines, your violation of law, or your infringement of a third party's rights.
17. Dispute resolution
Please read this section — it affects how disputes are resolved.
(a) Talk to us first. Email support@gradevu.com with a description of the issue and a 30-day window to resolve it informally.
(b) Governing law. These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. The Federal Arbitration Act governs Section 17.
(c) Binding arbitration. If we cannot resolve a dispute informally, you and we agree to resolve it by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The seat of arbitration is Denton County, Texas. The arbitrator may award the same individual relief a court could. Judgment on the award may be entered in any court of competent jurisdiction. You may bring a claim in small claims court instead if it qualifies.
(d) Class action waiver. You and we each waive the right to a trial by jury and the right to participate in a class action, class arbitration, or representative proceeding. The arbitrator may not consolidate claims without the consent of all parties.
(e) Right to opt out. You may opt out of arbitration and the class waiver by emailing privacy@gradevu.com with the subject "Arbitration Opt-Out" within 30 days of first accepting these Terms, including your name and the email on your account. Opting out does not affect any other part of these Terms.
(f) Carve-outs. Either party may seek injunctive relief in court to protect intellectual property or prevent unauthorized access. Either party may apply to a court to compel arbitration or enforce an award. Venue for those actions is the state or federal courts located in Denton County, Texas, and you consent to personal jurisdiction there.
(g) No participation in mass filings. To the extent permitted by law, disputes must be brought individually and not consolidated with any other person's claims.
18. Apple-specific terms
You and we acknowledge that:
these Terms are between you and GradeVu only, not with Apple;
Apple has no obligation to furnish maintenance or support for the app;
if the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app;
Apple is not responsible for addressing any claims relating to the app, including product liability, legal compliance, consumer protection, or intellectual property claims;
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you;
you represent that you are not located in a country subject to a U.S. Government embargo or designated as supporting terrorism, and are not on any U.S. Government prohibited-party list;
you will comply with applicable third-party terms when using the app.
19. General
Entire agreement. These Terms plus the Privacy Policy, Community Guidelines, and Public Certificate Page Notice are the entire agreement between us about the Service.
Changes. We may update these Terms. Material changes will be notified in-app, and continued use after the effective date is acceptance. If you do not agree, stop using the Service and delete your account.
Severability. If a provision is unenforceable, the rest remains in effect, and the unenforceable provision is limited to the minimum extent necessary.
No waiver. Our failure to enforce a provision is not a waiver.
Assignment. You may not assign these Terms. We may assign them in a merger, acquisition, or sale of assets.
Notices. Legal notices to us: Robles Consulting LLC, 100 Plaza Pl, Ste 300, PMB 58, Northlake, TX 76226, USA, with a copy to support@gradevu.com. Notices to you may be sent to your account email or posted in-app.
Force majeure. We are not liable for delays caused by events beyond our reasonable control.
